These Terms of Use apply to your use of the RecordRoom Sports website at recordroomsports.com and any public RecordRoom Sports pages or historical archives made available through it.
By using the website, you agree to these Terms of Use. If you do not agree, you should not use the website.
1. About RecordRoom Sports
RecordRoom Sports is operated by Benjamin James Thompson ABN 65 967 853 873.
RecordRoom Sports provides services that preserve, organise, structure and publish historical sporting records through searchable digital archives.
These Terms of Use govern use of the public website. They do not replace any quote, service agreement or other written agreement entered into between RecordRoom Sports and a client club.
2. Website information and service enquiries
Information on the RecordRoom Sports website is provided to explain RecordRoom Sports, its services, approach and examples of historical archive work.
Website content, an enquiry submission or preliminary discussion does not by itself create a client relationship, confirm a project scope, constitute a quote or commit either party to a project.
Where a club engages RecordRoom Sports, the project-specific scope, price, payment arrangements and service terms will be set out in the applicable RecordRoom Sports Quote and Service Agreement or other agreed written documents.
3. Historical archive information
Historical sporting archives are created from records and information supplied by clubs and other agreed source material. Historical records may contain omissions, inconsistencies, transcription errors, conflicting accounts or information that cannot be independently verified.
RecordRoom Sports takes reasonable steps to organise and reconcile historical information but does not guarantee that every archive is complete, that every historical error will be identified or that every uncertainty can be resolved.
RecordRoom Sports will not knowingly present unsupported historical information as established fact.
Where a supported factual error is identified, RecordRoom Sports may investigate and correct the public archive, including in consultation with the relevant club or authorised historical contact where appropriate.
4. Intellectual property and historical material
RecordRoom Sports retains rights in its website, archive platform, software, design systems, templates, data structures, processing methods, written business content, branding and other original RecordRoom Sports materials, except where those rights belong to another person or organisation.
Clubs and other rights holders retain their rights in original historical records, logos, photographs, documents and other material supplied or authorised for archive use.
RecordRoom Sports does not claim ownership of underlying sporting facts merely because those facts are displayed within a RecordRoom archive.
You may access and use the public website for ordinary personal, club, historical and informational purposes. Except as permitted by law or with appropriate permission, you must not reproduce, republish, sell, commercially exploit or systematically extract substantial parts of the website, archive presentation or RecordRoom Sports proprietary material.
5. Acceptable use
You must not use the website in a way that is unlawful, fraudulent, abusive or intended to damage, disrupt or compromise the website, its archives, systems or other users.
You must not attempt to gain unauthorised access to restricted systems or data, interfere with website security, introduce malicious code, impersonate another person or organisation, or use automated methods in a way that places an unreasonable load on the service.
Nothing in this section prevents ordinary search-engine indexing, accessibility tools, reasonable personal research or other use permitted by law.
6. Third-party links and services
The website may contain links to club websites, external historical sources, service providers or other third-party websites.
RecordRoom Sports does not control third-party websites and is not responsible for their content, availability, privacy practices or security. A link does not necessarily imply endorsement unless expressly stated.
7. Website availability and changes
RecordRoom Sports takes reasonable steps to keep its website and active public archives available and operational, but temporary interruptions may occur because of maintenance, technical faults, internet outages, third-party provider issues or circumstances outside RecordRoom Sports’ reasonable control.
RecordRoom Sports does not guarantee uninterrupted or error-free website availability.
RecordRoom Sports may update, correct, reorganise, suspend or remove website content where reasonably necessary, including to maintain historical accuracy, security, legal compliance or service operation.
8. Liability and legal rights
RecordRoom Sports will use reasonable care in operating the website and presenting its own services and archive content.
To the extent permitted by law, RecordRoom Sports is not responsible for loss arising solely from reliance on historical information that is incomplete, uncertain or affected by errors in source material, where RecordRoom Sports has not knowingly misrepresented that information.
Nothing in these Terms of Use excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
9. Privacy
Personal information collected through the website is handled in accordance with the RecordRoom Sports Privacy Policy.
The current Privacy Policy is available at recordroomsports.com/privacy.
10. Corrections and concerns
If you believe information published in a RecordRoom Sports archive is factually incorrect, raises a privacy or safety concern, or should be reviewed for another legitimate reason, you may contact RecordRoom Sports.
Historical correction and removal requests will be considered against available source evidence, the legitimate archival and sporting-history value of the information, privacy or safety concerns, the views of the relevant club where appropriate, and applicable legal obligations.
11. Changes to these Terms
RecordRoom Sports may update these Terms of Use when its website, services, technology, business practices or legal obligations change.
The current version will be made available through the RecordRoom Sports website. Continued use of the website after an updated version is published means the updated Terms will apply from that point, subject to any rights that cannot lawfully be limited.
12. Governing law
These Terms of Use are governed by the laws of New South Wales, Australia.
Subject to any rights a person may have to bring a claim in another court or tribunal under applicable law, disputes relating to these Terms or use of the website are subject to the jurisdiction of the courts and tribunals of New South Wales.
